These Terms of Service (“Terms”) govern your use of asiramrealty.com (the “Site”), operated by Asiram Realty LLC, doing business as Asiram Realty (“Asiram Realty,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

The Site provides real estate listing search, property information, and tools to help you learn about buying and selling property in the Permian Basin and surrounding areas. The Site is provided for your personal, non-commercial use.

2. No professional relationship until agreed in writing

Using the Site, submitting a form, or communicating with us does not by itself create a real estate brokerage, agency, or fiduciary relationship. A professional relationship is formed only through a separate written agreement signed by you and Asiram Realty.

3. Property listings and MLS data

Listing information is provided through IDX Broker and participating MLS providers. It is intended for your personal, non-commercial use, may not be used for any purpose other than to identify properties you may be interested in, and may not be reproduced or redistributed. All listing data is deemed reliable but is not guaranteed accurate, and all properties are subject to prior sale, change, or withdrawal. You should independently verify any information that matters to your decision.

4. Estimates, valuations, and calculators

The Site may offer tools that produce home value estimates, purchasing power figures, mortgage and affordability calculations, and similar outputs. These are automated estimates for general informational purposes only. They are not appraisals, lending decisions, tax advice, or financial advice, and actual values, loan terms, taxes, insurance, and costs will vary. Consult a licensed appraiser, lender, or financial professional before making decisions.

5. Information you submit

You agree that information you provide through the Site is accurate and that you are authorized to provide it. You are responsible for the content of your submissions. We may use submissions to respond to you and provide services as described in our Privacy Policy.

6. Intellectual property

The Site and its content, including text, graphics, logos, and design, other than third-party listing data and trademarks, are owned by or licensed to Asiram Realty and are protected by law. You may not copy, reproduce, or distribute Site content without our written permission.

7. Prohibited uses

You agree not to use the Site for any unlawful purpose, not to scrape, harvest, or collect listing data or other content by automated means, not to interfere with or disrupt the Site or its security, and not to use the Site to infringe the rights of others.

The Site relies on and links to third-party services, including IDX Broker, MLS providers, analytics, and others. We do not control these services and are not responsible for their content, availability, or practices.

9. Equal Housing Opportunity

Asiram Realty supports the principles of the Fair Housing Act and the Equal Opportunity Act. We do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, or any other protected class.

10. Disclaimer of warranties

The Site is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error free, or secure, or that any information on it is accurate or complete.

11. Limitation of liability

To the fullest extent permitted by law, Asiram Realty and its owners, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use the Site or reliance on any information or tool provided on it.

12. Indemnification

You agree to indemnify and hold harmless Asiram Realty and its owners, agents, and affiliates from any claims, damages, or expenses arising out of your use of the Site or your violation of these Terms.

13. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Reeves County, Texas.

14. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted, and the effective date above shows the latest revision. Your continued use of the Site after changes are posted means you accept the updated Terms.
